Prifina Acceptable Use Policy

Effective Date: March 24, 2025    

This Acceptable Use Policy (“AUP”) describes prohibited uses of, and activities on, the Prifina platform (the “Services”) to ensure a secure, fair, and respectful environment for all users. This policy is incorporated by reference into the Prifina Terms of Use. By accessing or using the Services, you agree to comply with both this AUP and the Terms of Use. Any capitalized terms not defined in this AUP have the meanings set forth in the Terms of Use.

1. Scope and Applicability
This AUP applies to all users of Prifina’s Services, including but not limited to:

• AI Twin Owners (those who create, train, or deploy AI Twins on the platform);
• AI Twin Users (individuals or entities interacting with AI Twins, whether on a free or premium account);
• Hub Participants (users who access The Hub to discover or be matched with AI Twins).

“Services” refers to the Prifina platform, APIs, websites, mobile applications, The Hub, and any additional features or content made available by Prifina.

2. Prohibited Content and Activities
You agree not to use the Services (including any AI Twins, user-generated content, or other features) to do, upload, post, share, facilitate, or encourage any of the following:

    1.    Illegal, Harmful, or Fraudulent Purposes

• Using the Services to violate any applicable law, regulation, or court order.
• Engaging in or facilitating criminal activity, including but not limited to hacking, identity theft, money laundering, or fraud.
• Uploading or distributing malware, viruses, or any other harmful code that can disrupt or damage the Services or users’ devices.

    2.    Harassment, Hate Speech, or Discrimination

• Harassing, bullying, threatening, or advocating violence against individuals or groups.
• Posting or generating content that is hateful, racist, bigoted, or that incites violence against any person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic.

    3.    Sexually Explicit or Exploitative Content

• Sharing or requesting sexually explicit content, pornography, or depictions of sexual violence.
• Strictly prohibited: Any content that exploits or harms minors, including child sexual abuse material (CSAM) or any form of grooming.

    4.    Defamatory or Infringing Material

• Uploading or distributing content that is defamatory, libelous, or violates another person’s privacy or publicity rights.
• Posting or generating content that infringes any third party’s intellectual property rights or proprietary rights (e.g., copyrighted text, images, or trademarks) without proper authorization.

    5.    Unauthorized Access or Security Violations

• Attempting to probe, scan, or test the vulnerability of any Prifina system, network, or user account without express permission.
• Circumventing or attempting to circumvent security measures, rate limits, or usage restrictions (including attempts to “jailbreak” or bypass AI Twin content filters).
• Impersonating other users, Prifina personnel, or AI Twins; or forging headers or other identifying information to disguise the origin of any data transmitted to or from the Services.

    6.    Spam and Excessive Automated Requests

• Sending unsolicited or unauthorized advertising, promotions, junk mail, spam, chain letters, or pyramid schemes.
• Making excessive automated queries that degrade performance or disrupt the Services, unless explicitly allowed by an official Prifina API or integration.

    7.    Misuse of AI Twins

• Repeatedly attempting to prompt AI Twins to generate disallowed or harmful content.
• Violating any additional guidelines Prifina provides regarding safe and responsible AI usage, including content moderation rules.

    8.    Any Other Harmful or Abusive Conduct

• Engaging in conduct that substantially disrupts the Services or the experience of other users, or that is considered offensive, deceptive, or harmful in Prifina’s sole discretion.

3. User Responsibilities

• Content Responsibility: You remain responsible for all content or information that you input, provide, or generate via the Services. This includes any text prompts, data sets, code, or other material you contribute to AI Twins or share with other users.
• Compliance With Local Laws: You must ensure that your use of the Services (including data collection, data sharing, and AI outputs) complies with all applicable laws and regulations in your jurisdiction.
• Reporting Violations: If you observe or become aware of any user or AI Twin engaging in prohibited behavior, please notify us at [[email protected]] or use any in-app reporting mechanism provided.

4. Enforcement and Consequences
Prifina reserves the right, in its sole discretion, to investigate, take preventive or corrective actions, and enforce this AUP if you violate (or we believe you are about to violate) any part of it. Actions we may take include, but are not limited to:

• Content Removal: Removing or disabling access to any content that violates this AUP.
• Account Suspension or Termination: Temporarily or permanently suspending your user account (including AI Twin Owner or AI Twin User accounts).
• Blocking or Throttling Access: Restricting your access to certain features or throttling usage to protect the integrity of the Services.
• Legal or Law Enforcement Involvement: Cooperating with law enforcement, including preserving or disclosing content or account details, or pursuing legal remedies as necessary.
• Other Remedies: Any other action permitted by our Terms of Use or applicable law.

Prifina may also remove or suspend any AI Twin that generates prohibited content or fails to comply with the relevant policies. We may act without prior notice if we believe an immediate action is required to protect users, systems, or third parties.

5. Monitoring and Moderation

• Automated and Manual Review: Prifina may use automated tools or conduct manual reviews to detect policy violations, security threats, or harmful behavior. However, we are not obligated to monitor all user activity or content.
• AI Twin Owner Oversight: AI Twin Owners are also expected to maintain safeguards (e.g., content filters, moderation) to ensure their AI does not generate or disseminate prohibited content. Prifina may request owners to implement additional controls or revise their models.

6. Modifications to This Policy
Prifina may revise or update this AUP at any time by posting an updated version at [prifina.com/legal/aup] (for example) or through other channels. The “Effective Date” at the top will reflect the most recent changes. Your continued use of the Services after any changes take effect constitutes your acceptance of the revised policy.
